News: INFORMATION HOMES FOR TOURIST PURPOSES AUTHORISATION

Dear Owners,

With regard to the agreements adopted concerning the tourist use of dwellings in Condado de Alhama and the possibility of obtaining Community authorisation, we inform you that, as the statutory period of 30 calendar days has now elapsed since the notification of the minutes of the last Extraordinary General Meetings (sent on 20 August 2025), no variation has occurred in the direction of the vote. Consequently, the agreements adopted at the Meetings are hereby confirmed as definitive, having achieved the double qualified majority of three-fifths of the owners and three-fifths of the participation quotas, in accordance with Article 17.8 of the Spanish Horizontal Property Act.

As was explained during the meetings, the agreement was initially adopted on a provisional basis by those present, but required the attainment of the said qualified majority including absent owners. Once the period has expired without any express opposition, the votes of such absent owners are deemed favourable, thus ratifying the agreement to amend the Statutes.

The next step, which is already underway, consists of preparing the documentation and completing the necessary preliminary procedures for submission to the Land Registry, where the amendment to the Articles of Association will be registered, expressly incorporating authorisation for tourist use of the properties in the different communities.

Once the registration has been completed, owners may request from the administration office the corresponding certificate of approval, which will serve as supporting documentation to accompany the application for the tourist apartment licence before the competent authority.

It is important to recall that neither the Community nor the Community’s Administration may grant individual authorisations until the Registrar of the Land Registry has formally recorded the agreements in the Statutes of the Community.

In the coming days, the documentation will be executed and filed with the Land Registry, of which you will be duly informed.
