News: LEVEL 1 NOTICE: Acquisition of the Resort access points
Dear Owners,
I am pleased to inform you that one of the most significant issues of recent years has been satisfactorily resolved, given its potential impact on the organisation, security, and daily life of the Residential Complex.
I am referring specifically to the legal status of the plots of land on which the four pavilions or general access gates to the Resort were built. As is known, these elements were privately owned, belonging exclusively to the developer (Polaris Group), in accordance with the configuration established in the Title deed of the horizontal property regime of the Complex. Consequently, they were not under the control of the Level I General Community.
This circumstance created a serious risk, particularly in view of the insolvency proceedings affecting the Polaris Group, since such assets — essential for the security of all owners — could have been acquired by third parties, whether external or even with particular interests within the Residential Complex, to the resulting detriment of all co-owners. It is easy to imagine the impact that would have arisen if the plots on which the access gates are located had passed into the hands of persons who could have conditioned their use, demanded substantial financial payments, or even hindered access.
Aware of the seriousness of this situation, negotiations were initiated in 2020 with the administrator of the bankruptcy of Polaris, and the corresponding purchase offer was submitted. Since then, a lengthy and complex process has taken place, requiring continuous monitoring of the insolvency proceedings in order to ensure that these assets were not transferred to persons with particular interests. Indeed, we became aware of specific unwanted attempts to acquire them, which were duly neutralised.
We are pleased to announce that, on 25 June 2026, the deed of sale was formally signed at the Notary of Torre Pacheco, Mr Juan Isidro Gancedo del Pino, in implementation of the final resolutions adopted at previous general meetings. The deed was ratified by the bankruptcy administrator of Polaris on July 20th.
By virtue of said deed, the General Community of Condado de Alhama has acquired, as common elements, full ownership of the four access pavilions, for a price of 15,000 euros, plus the costs and taxes arising from the transaction.
This acquisition definitively eliminates a structural and historical risk for the Residential Complex, ensuring community control over these infrastructures, which are so essential for the security and proper functioning of the Complex.
From this moment onwards, the plots on which the access gates are located become common elements, owned by all co-owners, providing full legal certainty and stability in their use.
